Gachagua Camp in Panic Mode as Lawyer Makes Urgent Appeal to CJ Koome Over By- Elections

Lawyer Ndegwa Njiru, a close ally of former Deputy President Rigathi Gachagua, has appealed to Chief Justice Martha Koome to urgently gazette an election court to enable legal challenges against by-election results in Mbeere North and Malava constituencies.

In a statement issued Thursday, Njiru adopted a notably diplomatic tone in his appeal to the Chief Justice and the Judiciary.

"We most humbly urge the Chief Justice @CJMarthaKoome @Kenyajudiciary to urgently gazette an election court to enable us file the necessary pleadings in respect to the Mbeere North and the Malava constituencies," the lawyer stated.

The careful phrasing contrasts with earlier combative statements from opposition figures, suggesting a strategic shift toward respectful engagement with judicial processes.

Njiru's statement indicates opposition plans to challenge results in both Mbeere North, where UDA's Leo wa Muthende defeated DCP's Newton Karish, and Malava, where UDA's Joseph Khalwale emerged victorious.

Both races were closely contested and marred by allegations of violence, intimidation, and electoral malpractice—claims that will form the basis of anticipated petitions.

Under Kenyan law, election petitions must be filed within 28 days of results declaration, but they can only be heard by specially designated election courts. 

Without a gazetted court, petitioners cannot formally lodge their challenges.

Njiru's appeal highlights the time-sensitive nature of the process, as the clock is already ticking on the petition deadline.

The lawyer's statement signals coordinated opposition legal strategy following the by-elections. 

Political activist Njeri Maina has already vowed to challenge the Mbeere North results, accusing IEBC of "ineptitude and complicity."

By targeting two constituencies rather than just Mbeere North, the opposition broadens its challenge to government electoral dominance and creates multiple fronts for contesting what they characterize as compromised processes..
