President William Ruto has faced yet another setback in the ongoing saga surrounding his appointment of 21 presidential advisors, following a fresh intervention by the Katiba Institute.

 The civil society organization has written to Controller of Budget Margaret Nyakang'o, demanding written confirmation that no salaries, allowances, or payments have been approved or disbursed to the former advisors since a landmark High Court ruling declared their positions unconstitutional.

In a letter dated February 4, 2026, Katiba Institute Executive Director Nora Mbagathi referenced the January 22, 2026, judgment by Justice Bahati Mwamuye.

The court found that President Ruto's creation of these advisory offices and subsequent appointments lacked a clear constitutional or statutory basis. 

The process bypassed key institutions, including the Public Service Commission and the Salaries and Remuneration Commission, raising serious concerns over the misuse of public funds without proper oversight.

The High Court not only quashed the appointments impacting prominent figures such as economist David Ndii and others but also permanently restrained the state from making any further payments or benefits to the advisors, their staff, or related offices. 

Katiba Institute emphasized compliance with Article 228 of the Constitution, which mandates the Controller of Budget's role in approving public expenditures.

Mbagathi requested assurance that no funds have been released since the judgment and that none will be authorized moving forward. 

She set a 14-day deadline for Nyakang'o's response, underscoring the need to safeguard taxpayer money amid the controversy.

This latest move comes after the court dismissed attempts by the affected advisors to secure a temporary stay or return to office for handover purposes, describing such requests as lacking legal merit.
